Trial date between County and Terminals inches closer

A potential trial between the County of Prince Edward and ABNA Investments (owner of Picton Terminals) looks to be in the offing some time in 2024.

The port operation faces charges levied by the Municipality’s bylaw department for contravening permitted activities on the site. Picton Terminals continues to store large shipping containers on its property despite zoning that does not allow such use. The County has held firm that only non-conforming, historic bulk shipment storage is permitted at the site and that container storage is not a permitted use.

The County filed charges in early May of this year.

Both parties were in Provincial Offences court on King St. Friday before Justice of the Peace Ruth Campbell.  Representing the County, Kennedy Levesque presented representatives of the law offices of Cunningham Swan with disclosure gathered by the municipality.

The matter was put off until Friday, Nov. 3, when a pretrial date could be set for the new year.
